Show me in any instance in history of someone going to court over the use of skins/models in a MODDED game. Otherwise the entirety of game modification itself would be deemed illegal and shut down for every game on PC. (And there are hundreds of games with moddable files) Illegal to use someone else's skins in a game and then sell that game for money? Yes. True. But seeing as RTCW is free and we don't plan on selling the mod, we'd be fine.
