There are lots of reasons why people are in spec we try not to kick people that are in spec unless absolutly necsssary ie. in spec for several maps and server is full but what we do have is alot of servers to pic from so if you find one full try another and then check back to the server you want by that time you will probably catch an open slot..... If they are truly away, i.e., they are not speccing anyone or talking. The server will kick them automatically when it is full. If you are finding the server is full often you might be interested in purchasing a private slot here

VIP Members

VIP benefit gives them protection against inactivity kick and they can stay in spec as much they like. Before you kick someone for inactivity check them and make sure they are not a VIP member! You can check VIP on the forums
